General Sales Conditions (GSC) and Terms of Use 

1. PURPOSE

The general sales conditions described below detail the rights and obligations of the company "PORTUGAL AUTÊNTICO, UNIPESSOAL LDA" and its Customer in the context of the sale of all the goods present in the "Shop" section of the "Eu Amo Portugal" website (https://euamoportugal.com).

Any service provided by the company "PORTUGAL AUTÊNTICO, UNIPESSOAL LDA" implies the buyer's unreserved acceptance of these general conditions of sale.

The general conditions of sale may be modified. Therefore, it is understood that the applicable conditions are those in force on the site at the time the order is placed on the site.

2. PRODUCTS

Our product and price offers are valid as long as they are visible on the Site, except for special operations whose validity period is specified on the Site. The buyer is invited to consult the availability of the items sold on the information page of each product.

In case of an order of an article that would be unavailable, Eu Amo Portugal reserves the right to cancel the order, subject to informing the buyer.

In case of an order of several products, if one of the products is finally unavailable, Eu Amo Portugal will inform the buyer of the impossibility of sending the unavailable article. The rest of the order will be processed and shipped to the customer. 

The photographs of the products, visible on each product page, are made with a high quality in order to obtain a faithful reproduction. However, the Customer may notice differences in the Products, especially due to the color settings of the device used by the Customer to access the Website, the colors displayed may differ from the real colors of the Products. Eu Amo Portugal cannot be held responsible for any damage suffered by the Customer due to differences between the Products and the photographic images of the Products.If the Customer wishes to obtain additional information about the Products, he/she can contact the customer service by e-mail, at "[email protected]".

3. ORDER

Purchases on the Site can only be made by persons 18 years of age or older or emancipated and having the full capacity to exercise their rights. 

To place an order, the buyer must proceed as follows:

  1. add the desired products to the basket;
  2. connect to his personal space or create a personal space if necessary;
  3. choose a delivery method and enter his personal information: name, first name, address and telephone number;
  4. proceed to payment (see "payment").

The buyer then receives an e-mail confirming the registration of his order and summarizing the products ordered. Once the order has been shipped, the buyer will receive another e-mail indicating the shipping date.

4. PAYMENT

4.1.. PRICE

The prices displayed by default on the site are indicated in euros, VAT included and excluding shipping costs. 

The VAT is applied at the rate in force at the time of the placing of the order. The prices of the products displayed on euamoportugal.com do not include shipping costs, prices of specific packaging or other optional services. The latter will be brought to the attention of the Internet user on the summary screen before final validation of the order.

The company "PORTUGAL AUTÊNTICO, UNIPESSOAL LDA" reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

4.2.. METHODS OF PAYMENT

The buyer can pay his purchases by credit card.

5. DELIVERY

The products can be delivered in the following countries: Portugal, Spain, France, Switzerland, Germany, Belgium, Luxembourg, the Netherlands, the United Kingdom, Ireland, Sweden, the USA and Canada.

Shipping costs are calculated according to the amount of the order and the delivery address. It is displayed on the summary screen before final validation of the order.

For orders shipped to the UK, the USA and Canada, all customs taxes and processing fees incurred are the responsibility of the customer. 

Packages are shipped within 2 to 3 business days, excluding weekends and holidays. The delivery time varies according to the country and the delivery method selected (Standard or Pick-up). The delivery time is specified in the shopping cart, during the validation of the order.

6. RETRACTION

In accordance with the legal provisions in force, the purchaser has a 14-day retraction period from the day of receipt of the order.

To make a return, the buyer must inform Eu Amo Portugal by sending an email to "[email protected]". He will receive a document that must be placed in the returned package. The shipping costs are at the charge of the buyer.

Eu Amo Portugal will refund the customer upon receipt of the returned product(s) and provided that the product(s) are in perfect condition. 

In case of refusal of delivery of the order and non-payment of the import duties leading to the return of the order, the shipping costs will not be refunded. In the event that your order is destroyed by customs, no refund will be made.

7. RESERVATION OF PROPERTY

Eu Amo Portugal retains full ownership of the purchased items until the buyer has fulfilled all his obligations and in particular until the price has been paid in full.

8. AFTER SALES SERVICE

Eu Amo Portugal remains at the disposal of its customers by e-mail: [email protected] for any question concerning a product and/or an order. An answer will be given as soon as possible.

9.INTELLECTUAL PROPERTY

The Site constitutes a work protected by the provisions of the Intellectual Property Code and the applicable International Regulations. The Customer may not in any way reuse, transfer or exploit for his own account all or part of the elements or works of the Site.

Thus, the Client declares and expressly recognizes that the contents, drawings, photographs, software, know-how, domain names, commercial names, logos, trademarks, designs and models and any other intellectual property right, whether registered or not, existing or used on the Site or linked to its exploitation are the exclusive property of EuAmoPortugal.

10. APPLICABLE LAW AND JURISDICTION

The contractual relations between Eu Amo Portugal (Portugal Autêntico, Unipessoal LDA) and the Customer are governed by Portuguese law and subject to the jurisdiction of the Portuguese courts.

11. MISCELLANEOUS

The headings of the clauses or their paragraphs have been included for convenience only and do not affect the interpretation of the General Sales Conditions (GSC).

Words and phrases defined in the singular or plural may be used in the plural or singular respectively without changing their meaning.

If any provision of the Terms and Conditions is held to be invalid or unenforceable in whole or in part, such invalidity, ineffectiveness or unenforceability shall not affect the validity of the remaining provisions or the continuation of the contractual relationship.
